
SERVICE TERMS AND CONDITIONS
Regulations for the Provision of Personal Training Services
In order to offer and ensure a high-quality service, both parties agree to comply with the following standards, which are designed to guarantee a professional and efficient service provision:
1. SCHEDULES AND SERVICE DURATION
1.1. Training Schedule
The training schedule is agreed upon during the initial consultation. Once established and mutually accepted by both the Client and the Trainer, all training sessions will take place at the agreed time.
If either party encounters an issue that prevents them from attending a scheduled session, they must notify the other party at least 24 hours in advance to avoid disruptions to the Trainer’s schedule.
The agreed schedule shall be considered final and may not be modified, as the Trainer’s availability for other clients is structured based on strict adherence to previously established time slots.
Working days are considered calendar days, without excluding public holidays or the Client’s vacation periods. Adjustments may be made for the Client’s benefit when possible, in accordance with Section 1.2.
A training month begins on the date of the first session and ends on the date of the last session.
All training contracts require a minimum commitment of three (3) months.
1.2. Rescheduling a Session
If the Client wishes to reschedule a session, they must notify the Trainer at least 24 hours in advance.
The Trainer will assess whether the change is feasible based on their existing commitments and will respond within a maximum of 12 hours.
If the requested change is not possible, the session will be recorded as “pending rescheduling” at the earliest possible date, without modifying the training month’s ending date, in order to maintain payment schedule integrity.
A maximum of two (2) sessions per month may be accumulated for rescheduling.
1.3. Grounds for Cancellation or Loss of a Session
A personal training session may be cancelled or considered lost under the following circumstances:
- If the same session is postponed twice consecutively, it will be removed from the schedule. This is equivalent to the Client being absent on two continuous training dates.
- If the Client fails to notify the Trainer about the inability to attend with the required 24-hour notice, the session will be forfeited.
- If weather conditions or force majeure prevent both parties from carrying out the session at the agreed time, the session will be rescheduled for the next available training date.
- If the Trainer proposes more than two (2) possible dates to recover a missed session and the Client does not confirm attendance to any of them, the session will be cancelled and will not be reinstated.
1.4. Vacation Periods or Extended Absences
The treatment of vacation periods or prolonged absences is as follows:
- If the Client will be absent for more than 4 weeks, they must pay a maintenance fee equivalent to 50% of their monthly training program cost. The fee will be calculated proportionally to the number of sessions missed within the month.
Sessions missed during this period will not be rescheduled.
Failure to pay the maintenance fee will be considered abandonment of the training slot, allowing the Trainer to assign it to another client. - Upon return, and provided the maintenance fee has been paid, the Client will begin a new training month, with payment due within the first five (5) calendar days of the new period.
- If the absence is less than 4 weeks, half of the missed sessions will be recovered.
In the case of an odd number of missed sessions, the number of recoverable sessions will be rounded in favor of the Client (e.g., 5 missed sessions → 3 recoverable).
1.5. Loss of Reserved Training Slot
A personal training slot may be revoked under the following circumstances:
- If the Client is absent and fails to respond to all communication attempts within 72 hours, this will be considered abandonment, and the Trainer may reassign the slot to another client.
- Loss of slot due to non-payment, as outlined in Section 2.3.
- If the Client repeatedly pays after the established deadline for three (3) or more consecutive months, the Trainer may reassign the slot at their discretion.
1.6. Duration of Sessions
Each training session has a maximum duration of 45 minutes.
Session time begins at the exact hour scheduled for the routine.
2. PAYMENT FOR THE TRAINING PROGRAM
2.1. Program Fees
The cost of the program is determined by the weekly training frequency selected by the Client.
This amount is fixed and must be paid to the Trainer no later than the fifth (5th) calendar day of each training month.
These five days are counted starting from the 1st day of each calendar month.
2.2. Payment Dates
The payment date is determined by the invoice corresponding to the current training period.
2.3. Non-Payment (Default)
In the event of unpaid invoices or returned payments, the following procedure applies:
- If an invoice has expired and five (5) calendar days have passed, it will be cancelled and reissued with a 5% surcharge, with a new deadline of 5 business days.
- If an invoice remains unpaid for more than 25 days, the situation will be considered abandonment of the reserved slot, and the Trainer may reassign the slot to a new client.
2.4. Payment Methods
The Client may pay through direct debit using our online payment platform.
If a partial month occurs, payment may be made via bank transfer or cash.
Cheque payments are not accepted.
2.5. Refund Policy
Refunds are not contemplated.
Once a time slot is reserved, it remains exclusively assigned to the Client for the duration of their training program.
If the Client suspends the program due to force majeure for more than one calendar month, the Trainer may reassign the reserved slot to other clients.
The continuation of the program upon the Client’s return will take place according to the Trainer’s available time slots at that moment.
The intention is to prevent any training program from becoming fragmented or incomplete.
